Defending the Rights of Injured Workers

When you have been hurt on the job, you not only have to live with the pain and suffering of your injuries but you also have to face the financial impact of the accident. In addition to being temporarily or permanently out of work, you may have been left with substantial medical bills for emergency treatment, hospitalization, and rehabilitative care. Fortunately, you have options for pursuing financial compensation to cover your costs and help you support your family now and into the future. You can find caring support and aggressive legal representation during this difficult experience by contacting us at Brian McCaffrey Attorney at Law, P.C.

Workers’ Compensation Benefits

Nearly all businesses in New York are required by state law to provide workers’ compensation insurance coverage so that their employees can claim benefits in the event of an accident on the job. While this law makes it possible for injured employees to recover much-needed financial compensation, the fact is that workers’ comp benefits are limited and are typically not substantial enough to provide for the worker and his or her family. Your benefits for replacement of lost wages are limited to two-thirds of your average weekly wage, multiplied by your disability rating. For example, if you normally earn $1,000 and have been given a disability rating of 75%, you will only be able to receive about $500 per week. We can help you pursue workers’ compensation benefits, but we also may be able to help you find another option for compensation.
